Judicial magistrates in Mozambique are working on a proposal for a law establishing financial independence for the courts. The Mozambican Association of Judges believes this could address numerous issues affecting the judiciary, while also noting a reduction in corruption among judges. Additionally, there is concern about police conduct during demonstrations, urging for peaceful and lawful protests.
In the upcoming days, judicial magistrates and the Public Prosecutor’s Office in Mozambique are set to propose a law aimed at establishing the financial independence of the courts. This initiative seeks to address the numerous challenges currently faced by the judiciary. Esmeraldo Matavele, the president of the Mozambican Association of Judges (AMJ), confirmed that a dedicated committee is finalizing a preliminary proposal to submit to the government, which can then forward it to Parliament.
Matavele expressed optimism that the proposed law could resolve approximately ninety percent of the judiciary’s issues. These issues include concerns regarding salaries, security, medical and drug assistance, transportation, and housing. Until the proposal is advanced, the judges hope for governmental intervention regarding specific matters related to their classification in the Single Salary Table (TSU).
The AMJ has played an active role in this process, providing its insights and now anticipates the government’s approval of these necessary changes. Furthermore, Matavele reported a significant decline in corruption within the judiciary. Notably, until 2022, an annual average of two to three judges faced expulsion for corruption; however, no such removals have occurred in 2023, and there are no ongoing disciplinary actions for corruption alarming.
He stressed that judges are increasingly aware of maintaining integrity and refraining from corrupt practices, particularly those involving misappropriated court funds. Matavele further condemned the excessive use of police force during demonstrations, which he reported led to fatalities. He advocated for lawful and orderly demonstrations, emphasizing the responsibility of both the police and citizens to ensure peace and avoid property damage.
The proposed financial independence law for Mozambique’s judiciary aims to significantly alleviate various issues experienced by judges, including concerns over salaries and security. The commitment of the Mozambican Association of Judges towards ethical conduct within the judicial system marks a positive trend towards curbing corruption.
