RWE is being challenged under German property law, typically employed against neighbors, as Lliuya associates the company’s operations, specifically its coal power plants, with significant carbon emissions. He contends that since its inception in 1898, RWE has contributed 0.47% of all greenhouse gas emissions. Consequently, Lliuya is seeking 0.47% of the estimated $18,000 cost necessary to construct a dyke for flood protection in Huaraz.

Saul Luciano Lliuya expressed his deep concern, stating that rising rain levels and swelling rivers instill fear among local inhabitants. “It is scary, the risk from climate change. There is a lot of fear and the lake’s levels have risen,” he remarked. Francesca Mascha Klein, an attorney with Germanwatch supporting Lliuya, emphasized the urgency for corporations to acknowledge their environmental impact by stating, “No one should live in fear of losing their home due to the climate crisis. Polluters have to step up and pay the true price of their business model.”
